The Governments of the Kingdom of Belgium, the Kingdom of Denmark, the French Republic, the Irish Republic, the Italian Republic, the Grand Duchy of Luxembourg, the Kingdom of the Netherlands, the Kingdom of Norway, the Kingdom of Sweden and the United Kingdom of Great Britain and Northern Ireland.

Convinced that the pursuit of peace based upon justice and international co-operation is vital for the preservation of human society and civilisation;

Reaffirming their devotion to the spiritual and moral values which are the common heritage of their peoples and the true source of individual freedom, political liberty and the rule of law, principles which form the basis of all genuine democracy;

Believing that, for the maintenance and further realisation of these ideals and in the interests of economie and social progress, there is nedd of a closer unity between all like-minded countries of Europe;

Considering that, to respond to this need and to the expressed aspirations of their peoples in this regard, it is necessary forthwith to create an organisation which will bring European States into closer association.

Have in consequence decided to set up a Council of Europe consisting of a Committee of representatives of Governments and of a Consultative Assembly, and have for this purpose adopted the following Statute:

Chapter I

Aim of the council of Europe

Article 1

a) The aim of the Council of Europe is to achieve a greater unity between its Members for the purpose of safeguarding and realising the ideals and principles which are their common heritage and facilitating their economic and social progress.

b) This aim shall be pursued through the organs of the Council by discussion of questions of common concern and by agreements and common action in economic, social, cultural, scientific, legal and adminisrative matters and in the maintenance and further realisation of human rights and fundamental freedoms.

c) Participation in the Council of Europe shall not affect the collaboration of its Members in the work of the United Nations and of other international organisations or unions to which they are parties.

d) Matters relating to national defence do not fall within the scope of the Council of Europe.

Chapter II

Membership

Article 2

The Members of the Council of Europe are the Parties to this Statute.

Article 3

Every Member of the Council of Europe must accept the principles of the rule of law and of the enjoyment by all persons within its jurisdiction of human rights and fundamental freedoms, and collaborate sincerely and effectively in the realisation of the aim of the Council as specified in Chapter I.

Article 4

Any European State which is deemed to be able and willing to fulfil the provisions of Article 3 may be invited to become a Member of the Council of Europe by the Committee of Ministers. Any State so invited shall become a Member on the deposit on its behalf with the Secretary General of an instrument of accession to the present Statute.

Article 5

a) In special circumstances, a European country which is deemed to be able and willing to fulfil the provisions of Article 3 may be invited by the Committee of Ministers to become an Associate Member of the Council of Europe. Any country so invited shall become an Associate Member on the deposit on its behalf with the Secretary General of an instrument accpeting the present Statute. An Associate Member shall be entitled to be represented in the Consultative Assembly only.

b) The expression „Member” in this Statute includes an Associate Member except when used in connection wich representation on the Committee of Ministers.

Article 6

Before issuing invitations under Article 4 or 5 above, the Committee of Ministers shall determine the number of Representatives on the Consultative Assembly to which the proposed Member shall be entitled and its proportionate financial contribution.

Article 7

Any Member of the Council of Europe may withdraw by formally notifying the Secretary General of its intention to do so. Such withdrawal shall take effect at the end of the financial year in which it is notified, if the notification is given during the first nine months of the financial year. If the notification is given in the last three months of the financial year, it shall takte effect at the end of the next financial year.

Article 8

Any Member of the council of Europe which has seriously violated article 3 may be suspended from its rights of representation and requested by the Committee of Ministers to withdraw under Article 7. If such Member does not comply with this request, the Committee may decide that it has ceased to be a Member of the Council as from such date as the Committee may determine.

Article 9

The Committee of Ministers may suspend the right of representation on the Committee and on the Consultative Assembly of a Member which has failed to fulfil its financial obligation during such period as the obligation remains unfulfilled.

Chapter III

General

Article 10

The organs of the Council of Europe are:

(i) the Committee of Ministers;

(ii) the Consultative Assembly.

Both these organs shall be served by the Secretariat of the Council of Europe.

Article 11

The seat of the Council of Europe is at Strasbourg.

Article 12

The official languages of the Council of Europe are English and French. The Rules of Procedure of the Committee of Ministers and of the Consultative Assembly shall determine in what circumstances und under what conditions other languages may be used.

Chapter IV

Committee of Ministers

Article 13

The Committee of Ministers is the organ which acts on behalf of the Council of Europe in accordance with articles 15 and 16.

Article 14

Each Member shall be entitled to one representative on the Committee of Ministers, and each representative shall be entitled to one vote. Representatives on the Committee shall be the Ministers for Foreign Affairs. When a Minister for Foreign Affairs is unable to be present or in other circumstances where it may be desirable, an alternate may be nominated to act for him, who shall, whenever possible, be a member of his Government.

Article 15

a) On the recommendation of the Consultative Assembly or on its own initiative, the Committee of Ministers shall consider the action required to further the aim of the Council of Europe, including the conclusion of conventions or agreements and the adoption by Governments of a common policy with regard to particular matters. Its conclusions shall be communicated to Members by the Secretary General.

b) In appropriate cases, the conclusion of the Committee may take the form of recommendation to the Governments of Members, and the Committee may request the Government of Members to inform it of the action taken by them with regard to such recommendations.

Article 16

The Committee of Ministers shall, subject to the provisions of Articles 24, 28, 30, 32, 33 and 35, relating to the powers of the Consultative Assembly, decide with binding effect all matters relating to the internal organisation and arrangements of the Council of Europe. For this purpose the Committee of Ministers shall adopt such financial and administrative regulations as may be necessary.

Article 17

The Committee of Ministers may set up advisory and technical committees or commissions for such specific purposes as it may deem desirable.

Article 18

The Committee of Ministers shall adopt its Rules of Procedure, which shall determine amongst other things:

(i) the quorum;

(ii) the method of appointment and term of office of its President;

(iii) the procedure for the admission of items to its agenda, including the giving of notice of proposals for resolutions; and

(iv) the notifications required for the nomination of alternates under Article 14.

Article 19

At each session of the Consultative Assembly the Committee of Ministers shall furnish the Assembly with statements of its activities, accompanied by appropriate documentation.

Article 20

a) Resolutions of the Committee of Ministers relating to the following important matters, namely:

(i) recommendations under Article 15 b);

(ii) questions under Article 19;

(iii) questions under Article 21 a) i and b);

(iv) questions under Article 33;

(v) recommendations for the amendment of Articles 1d),7, 15, 20 and 22, and

(vi) any other question which the Committee may, by a resolution passed under d) below, decide should be subject to a unanimous vote on account of its importance require the unanimous vote of the representatives casting a vote, and of a majority of the representatives entitled to sit on the Committee.

b) Questions arising under the Rules of Procedure or under the financial and administrative regulations may be decided by a simple majority vote of the representatives entitled to sit on the Committee.

c) Resolutions of the Committee under Articles 4 and 5 require a two-thirds majority of all the representatives entitled to sit on the Committee.

d) All other Resolutions of the Committee, including the adoption of the Budget, of Rules of Procedure and of financial and administrative regulations, recommendations for the amendment of Articles of this Statute, other than those mentioned in paragraph a) (v) above, and deciding in case of doubt which paragraph of this Article applies, require a two-thirds majority of the representatives casting a vote and a majority of the representatives entitled to sit on the Committee.

Article 21

a) Unless the Committee decides otherwise, meetings of the Committee of Ministers shall be held:

(i) in private, and

(ii) at the seat of the Council.

b) The Committee shall determine what information shall be published regarding the conclusions and discussion of a meeting held in private.

c) The Committee shall meet before and during the beginning of every session of the Consultative Assembly and at such other times as it may decide.

Chapter V

Consultative Assembly

Article 22

The Consultative Assembly is the deliberative organ of the Council of Europe. It shall debate matters within its competence under this Statute and present its conclusions, in the form of recommendations, to the Committee of Ministers.

Article 23

a) The Consultative Assembly may discuss and make recommendations upon any matter within the aim and scope of the Council of Europe as defined in Chapter I. It shall also discuss and may make recommendations upon any matter referred to it by the Committee of Ministers with a request for its opinion.

b) The Assembly shall draw up its Agenda in accordance with the provisions of paragrapha)above. In so doing, it shall have regard to the work of other European intergovernmental organisations to which some or all of the Members of the Council are tarties.

c) The Presiedent of the Assembly shall decide, in case of doubt, whether any question raised in the course of the Session is within the Agenda of the Assembly.

Article 24

The Consultative Assembly may, with due regard to the provisions of Article 38 d) establish committees or commissions to consider and report to it on any matter which falls within its competence under Article 23, to examine and prepare questions on it Agenda and to advise on all matters of procedure.

Article 25

a) The Consultative Assembly shall consist of Representatives of each Member, elected by its Parliament from among the members thereof, or appointed from among the members of that Parliament, in such manner as it shall decide, subject, however, to the right of each Member Government to make any additional appointments necessary when the Parliament is not in session and has not laid down the procedure to be followed in that case. Each Representative must be a national of the Member whom he represents, but shall not at the same time be a member of the Committee of Ministers.

The term of office of Representatives thus appointed will date from the opening of the Ordinary Session following their appointment; it will expire at the opening of the next Ordinary Session or of a later Ordinary Session, except that, in the event, of elections to their Parliaments having taken place, Members shall be entitled to make new appointments.

b) No Representative shall be deprived of his position as such during a Session of the Assembly without the agreement of the Assembly.

c) Each Representative may have a Substitute who may, in the absence of the Representative, sit, speak and vote in his place. The provisions of paragraph a) above apply to the appointment of Substitutes.

Article 26

Members shall be entitled to the number of Representatives given below:

Article 27

The conditions under which the Committee of Ministers collectively may be represented in the debates of the Consultative Assembly, or individual representatives on the Committee or their alternates may address the Assembly, shall be determined by such Rules of Procedure on this subject as may be drawn up by the Committee after consulation with the Assembly.

Article 28

a) The Consultative Assembly shall adopt its Rules of Procedure and shall elect from its members its President, who shall remain in office until the next Ordinary Session.

b) The President shall controll the proceedings but shall not take part in the debate or vote. The Substitute of the Representative who is President may sit, speak and vote in his place.

c) The Rules of Procedure shall determine inter alia:

(i) the quorum;

(ii) the manner of the election and terms of office of the President and other officers;

(iii) the manner in which the Agenda shall be drawn up and be communicated to Representatives; and

(iv) the time and manner in which the names of Representatives and their Substitutes shall be notified.

Article 29

Subject to the provisions of Article 30, all resolutions of the Consultative Assembly, including resolutions:

(i) embodying recommendations to the Committee of Ministers;

(ii) proposing to the Committee matters for discussion in the Assembly;

(iii) establishing committees or commissions;

(iv) determining the date of commencement of its Sessions;

(v) determining what majority is required for resolutions in cases not covered by (i) to (iv) above or determining cases of doubt as to what majority is required,

shall require a two-thirds majority of the Representatives casting a vote.

Article 30

On matters relating to its internal procedure, which includes the election of officers, the nomination of persons to serve on committees and commissions and the adoption of Rules of Procedure, resolutions of the Consultative Assembly shall be carried by such majorities as the Assembly may determine in accordance with Article 29(v).

Article 31

Debates on proposals to be made to the Committee of Ministers that a matter should be placed on the Agenda of the Consultative Assembly shall be confined to an indication of the proposed subject-matter and the reasons for and against its inclusion in the Agenda.

Article 32

The Consultative Assembly shall meet in ordinary session once a year, the date and duration of which shall be determined by the Assembly so as to avoid as far as possible overlapping with parliamentary sessions of Members and with sessions of the General Assembly of the United Nations. In no circumstances shall the duration of an ordinary session exceed one month unless both the Assembly and the Committee of Ministers concur.

Article 33

Ordinary sessions of the Consultative Assembly shall be held at the seat of the Council unless both the Assembly and the Committee of Ministers concur that the session should be held elsewhere.

Article 34

The Consultative Assembly may be convened in Extraordinary Session, upon the initiative either of the Committee of Ministers or of the President of the Assembly after agreement between them, such agreement also to determine the date and place of the Session.

Article 35

Unless the Consultative Assembly decides otherwise, its debates shall be conducted in public.

Chapter VI

Secretariat

Article 36

a) The Secretariat shall consist of a Secretary General, a Deputy Secretary General and such other staff as may be required.

b) The Secretary General and Deputy Secretary General shall be appointed by the Consultative Assembly on the recommendation of the Committee of Ministers.

c) The remaining staff of the Secretariat shall be appointed by the Secretary General in accordance with the administrative regulations.

d) No member of the Secretariat shall hold any salaried office from any Government or be a member of the Consultative Assembly or of any national legislature or engage in any occupation incompatible with his duties.

e) Every member of the staff of the Secretariat shall make a solemn declaration affirming that his duty is to the Council of Europe and that he will perform his duties conscientiously, uninfluenced by any national considerations, and that he will not seek or receive instructions in connection with the performance of his duties from any Government or any authority external to the Council and will refrain from any action which might reflect on his position as an international official reponsible only to the Council. In the case of the Secretary General and the Deputy Secretary General this declaration shall be made before the Committee, and in the case of all other members of the staff, before the Secretary General.

f) Every Member shall respect the exclusively international character of the responsibilities of the Secretary General and the staff of the Secretariat and not seek to influence them in the discharge of their responsibilities.

Article 37

a) The Secretariat shall be located at the seat of the Council.

b) The Secretary General is responsible to the Committee of Ministers for the work of the Secretariat. Amongst other things, he shall, subject to Article 38d)provide such secretariat and other assistance as the Consultative Assembly may require.

Chapter VII

Finance

Article 38

a) Each Member shall bear the expenses of its own representation in the Committee and in the Consultative Assembly.

b) The expenses of the Secretariat and all other common expenses shall be shared between all Members in such proportions as shall be determined by the Committee on the basis of the population of Members.

The contributions of an Associate Member shall be determined by the Committee.

c) In accordande with the financial regulations, the Budget of the Council shall be submitted annually by the Secretary General for adoption by the Committee.

d) The Secretary General shall refer to the Committee requests from the Assembly which involve expenditure exceeding the amount already allocated in the Budget for the Assembly and its activities.

e) The Secretary General shall also submit to the Committee of Ministers an estimate of the expenditure to which the implementation of each of the recommendations presented to the Committee would give rise. Any resolution the implementation of which requires additional expenditure shall not be considered as adopted by the Committee of Ministers unless the Committee has also approved the corresponding estimates for such additional expenditure.

Article 39

The Secretary General shall each year notify the Government of each Member of the amount of its contribution, and each Member shall pay to the Secretary General the amount of its contribution, which shall de deemed to be due on the date of its notification, not later than six months after that date.

Chapter VIII

Privileges and immunities

Article 40

a) The Council of Europe, representatives of Members and the Secretariat shall enjoy in the territories of its Members such privileges and immunities as are reasonably necessary for the fulfilment of their functions. These immunities shall include immunity for all Representatives to the Consultative Assembly from arrest and all legal proceedings in the territories of all Members, in respect of words spoken and votes cast in the debates of the Assembly or its committees or commissions.

b) The Members undertake as soon as possible to enter into agreement for the purpose of fulfilling the provisions of paragraph a) above. For this purpose the Committee of Ministers shall recommend to the Governments of Members the acceptance of an Agreement defining the privileges and immunities to be granted in the territories of all Members. In addition a special Agreement shall be concluded with the Government of the French Republic defining the privileges and immunities which the Council shall enjoy at its seat.

Chapter IX

Amendments

Article 41

a) Proposals for the amendment of this Statute may be made in the Committee of Ministers or, in the conditions provided for in Article 23, in the Consultative Assembly.

b) The Committee shall recommend and cause to be embodied in a Protocol those amnedments which it considers to be desirable.

c) An amending Protocol shall come into force when it has been signed and ratified on behalf of twothirds of the Members.

d) Notwithstanding the provisions of the preceding paragraphs of this Article, amendments to Articles 23-35, 38 and 39., which have been approved by the Committee and by the Assembly, shall come into force on the date of the Certificate of the Secretary General, transmitted to the Governments of Members, certifying that they have been so approved. This paragraph shall not operate until the conclusion of the second ordinary session of the Assembly.

Chapter X

Final provisions

Article 42

a) This Statute shall be ratified. Ratifications shall be deposited with the Government of the United Kingdom of Great Britain and Northern Ireland.

b) The present Statute shall come into force as soon as seven instruments of ratification have been deposited. The Government of the United Kingdom shall transmit to all signatory Governments a certificate declaring that the Statute has entered into force and giving the names of the Members of the Council of Europe on that date.

c) Thereafter each other signatory shall become a Party to this Statute as from the date of the deposit of its instrument of ratification.

In witness whereof the undersigned, being duly authorised thereto, have signed the present Statute.

Done at London, this 5 th day of May, 1949, in English and French, both texts being equally authentic, in a single copy which shall remain deposited in the archives of the Gover United Kingdom which shall transmit certified copies to the other signatory Governements.

Statutory Resolutions

I.

Resolution adopted by the Committee of Ministers at its
Eighth Session May, 1951

The Committee of Ministers,

Having regard to certain proposals made by the Consulative Assembly for the revision of the Statute of the Council of Europe;

Considering that the provisions hereinafter set out are not inconsistent with the present Statute,

Declares its intentions of putting into effect the following provisions:

Admission of new Members

The Committee of Ministers, before inviting a State to become a Member or Associate Member of the Council of Europe, in accordance with Articles 4 and 5 of the Statute, or inviting a Member of the Council of Europe to withdraw, in accordance with Article 8, shall first consult the Consultative Assembly in accordance with existing practice.

Powers of the Committee of Ministers

(Article 15 of the Statute)

The conclusions of the Committee may, where appropriate, take the form of a convention or agreement. In that event the following provisions shall be applied:

(i) The convention or agreement shall be submitted by the Secretary General to all Members for ratification;

(ii) Each Member undertakes that within one year of such submission, or, where this is impossible owing to exceptional circumstances within eighteen months, the question of ratification of the convention or agreement shall be brought before the competent authority or authorities in its country;

(iii) The instruments of ratification shall be deposited with the Secretary General;

(iv) The convention or agreement shall be binding only on such Members as have ratified it.

Joint Committee

(i) The Joint Committee is the organ of co-ordination of the Council of Europe. Without prejudice to the repective rights of the Committee of Ministers and the Consultative Assembly, the functions of the Joint Committee shall be in particular:

a) to examine the problems which are common to those two organs;

b) to draw the attention of those two organs to questions which appear to be of particular interest to the Council of Europe;

c) to make proposals for the draft Agenda of the sessions of the Committee of Ministers and of the Consultative Assembly;

d) to examine and promote means of giving practical effect to the recommendations adopted by one or other of these two organs.

(ii) a) The Joing Committee shall be composed in principle of twelve members, five representing the Committee of Ministers and seven representing the Consultative Assembly, the latter number to include the President of the Consultative Assembly, who shall be a memberex officio.

The Number or members may be increased by agreement between the Committee of Ministers and the Assembly. Nevertheless, the Committee of Ministers shall, at its discretion, be entitled to increase the number of its representatives by one or two.

b) The Committee of Ministers and the Consultative Assembly shall each be free to choose its own method of selecting its representatives on the Joint Committee.

c) The Secretary General shall be entitled to atend the meetings of the Joint Committee in an advisory capacity.

(iii) a) The President of the Consultative Assembly shall be the Chairman of the Joint Committee.

b) No proceedings of the Committee shall be regarded as valid unless there is a quorum consisting of three of the representatives of the Committee of Ministers and five of the representatives of the Consultative Assembly.

c) The conclusing of the Joint Committee shall be reached without voting.

d) The meetings of the Joint Committee shall be convened by the Chairman and shall take place as often as is necessary and, in particular, before and after the sessions of the Committee of Ministers and of the Consultative Assembly.

e) Subject to the foregoing provisions, the Joint Committee may adopt its own Rules of Procedure.

Specialised Authorities

(i) a) The Council of Europe may take the initiative of instituting negotiations between Members with a view to the creation of European Specialised Authorites, each with its own competence in the economic, social, cultural, legal, administrative or other related fields.

b) Each Member shall remain free to adhere or not to adhere to any such European Specialised Authority.

(ii) If Member States set up European Specialised Authorites among themselves on their own initiative, the desirability of bringing these Authorities into relationship with the Council of Europe shall be considered, due account being taken of the interests of the European community as a whole.

(iii) a) The Committee of Ministers may invite each Authority to submit to it a periodical report on its acitivities.

b) Insofar as any agreement setting up a Specialised Authority provides for a parliamentary body, this body may be invited to submit a periodical report to the Consultative Assembly of the Council of Europe.

(iv) a) The conditions under which a Specialised Authority shall be brought into relationship with the council may be determined by special agreements concluded between the Council and the Specialised Authority concerned. Such agreement may cover, in particular:

1. reciprocal representation and, if the question arises, appropriate forms of integration between the organs of the Council of Europe and those of the Specialised Authority;

2. the exchange of information, documents and statistical data;

3. the presentation of reports by the Specialised Authority to the Council of Europe and of recommendations of the Council of Europe to the Specialised Authority;

4. arrangements concerning staff and administrative, technical, budgetary and financial services.

b) Such agreements shall be negotiated and concluded on behalf of the Council of Europe by the Committee of Ministers after an opinion has been given by the Consultative Assemby.

(v) The Council of Europe may co-ordinate the work of the Specialised Authorities brought into relationship with the council of Europe in accordance with the foregoing provisions by holding joint discussions and by submitting recommendations to them, as well as by submitting recommendations to Member Governements.

Relations eith inter-governmental and non-governmental
international organisations

(i) The Committee of Ministers may, on behalf of the Council of Europe, conclude with any intergovernmental organisation agreements on matters which are within the competence fo the Council. These agreements shall, in particular, define the terms on which such an organisation shall be brought into relationship with the Council of Europe.

(ii) The Council of Europe, or any of its organs, shall be authorised to exercise any functions coming within the scope of the Council of Europe which may be entrusted to it by other European intergovernmental organisations. The Committee of Ministers shall conclude any agreements necessary for this purpose.

(iii) The agreement referred to in paragraph(i)may provide, in particular:

a) that the Council shall take appropriate steps to obtain from, and furnish to, the organisations in question regular reports and information, either in writing or orally;

b) that the Council shall give opinions and render such services as may be requested by these organisations.

(iv) The Committee of Ministers may, on behalf of the Council of Europe, make suitable arrangements for consultation with international non-governmental organisations which deal with matters that are within the competence of the Council of Europe.

II.

Partial Agreements

(Resolution adopted by the Committee of Ministers at
its Ninth Session August, 1951)

The Committee of Ministers,

Having regard to Article 20a)of the Statute, which provides that recommendations by the Committee of Ministers to Member Governments require the unanimous vote of the representatives casting a vote and of a majority of the representatives entitled to sit on the Committee;

Having regard to Recommendation 3 adopted by the Consultative Assembly in August 1950;

Desirous, whenever possible, of reaching agreement by unaninmous decision, but recognising, nevertheless, that in certain circumstances individual Members may wish to abstain from participating in a course of action advocated by other Members;

Considering that it is desirable for this purpose that the procedure of abstention already recognised under Article 20a)of the Statute should be so defined that the individual representatives on the Committee of Ministers should be able, by abstaining from mittee of Ministers should be able, by abstaining from voting for a proposal, to avoid committing their Governements to the decision taken by their colleagues,

Reseolves:

1. If the Committee, by the unanimous vote of the representatives casting a vote and of a majority of the representatives entitled to sit on the Committee, decides, that abstention from participation in any proposal before it shall be permitted, that proposal shall be put to the Committee; it shall be considered as adopted only by the representatives who then vote in favour of it, and its application shall be limited accordingly.

2. Any additional expenditure incurred by the Council in connection with a proposal adopted under the above procedure shall be borne exclusively by the Members whose representatives have voted in favour of it.

Regulations
relating to the appointment of the Secretary General
Deputy Secretary General and Clerk of the Assembly.

1. Submission of candidatures

a) When a vacancy occurs in any, of the three senior posts of the Secretariat General, appointments to which are made by the Consultative Assembly on the recommendation of the Committee of Ministers, or in the case provided for in clause 8b)below, candidates may be proposed to the Committee of Ministers:

(i) by one or more Member Governments;

(ii) by the Secretary General, in respect of the posts of Deputy Secretary General and Clerk of the Assembly.

Furthermore, when the post of Clerk of the Consultative Assembly falls vacant, or in the case provided for in clause 8 b), proposals may be submitted to the Committee of Ministers by one or more groups of Representatives to the Consultative Assembly, they should bear not less than five and not more than ten signatures.

The Secretary General may only propose candidates who are already permanent or temporary members of the Secretariat General.

Candidates from the Secretariat General may also be sponsored by one or more Member Governments, provided that in the case of the Deputy Secretary General or Clerk of the consultative Assembly the Secretary General has been previously consulted and has given his assent.

b) Member Governments and Assembly Representatives shall send their proposals to the Secretary General, who will forward them, together with his own, to the Committee of Ministers.

2. Criteria determinig the choice of candidates

The following criteria shall determine the choice of candidates:

a) The recruitment of persons of the highest ability and integrity an suitability for the post to be filled.

b) The qualifications and experience of persons already employed by the Council of Europe shall be taken into consideration, so that members of the Secretariat may have reasonable prospects of promotion.

c) The desirability of ensuring an equitable geographical allocation of appointments among nationals of the Member States subject to the overriding interests of efficiency. No office in the Secretariat shall be considered to be the prerogative of any particular Member State.

3. Preliminary examination of candidatures by the Committee of Ministers

The Committee of Ministers shall examine the list of candidates. The latter may be summoned to an interview by the Committee itself or by a Sub-Committee appointed for the purpose.

4. Consultation of the Assembly by the Committee of Ministers

Before transmitting to the Consultative Assembly a recommendation for the appointment of any one of the three senoir officials of the Secretariat General, the Committee of Ministers shall consult the Assembly on the subject through the medium of the Joint Committee.

This consultation shall take place, unless otherwise agreed to by the Joint Committee, not less than thirty days before the date of the opening of the Session during which the Assembly will be called upon to make the appointment.

5. Nomination of candidates

a) Unless it has been otherwise agreed after discussion in the Joint Committee, the Committee of Ministers shall draw up a list containing at least two names, which shall be submitted to the Assembly.

b) In the case of candidates for the posts of Secretary General and Deputy Secretary General, the Committee of Ministers shall be free to list the names in order of preference, should it so desire.

6. Procedure in the Bureau

The proposals submitted to the Assembly by the Committee of Ministers shall be examined by the Bureau, which may summon candidates to an interview. The Bureau shall then transmit the proposals to the Assembly, indicating, if it thinks fit and where appropriate, its own order of preference and the order of preference of the Committee of Ministers with regard to the candidates.

7. Procedure in the Assembly

a) The Assembly shall proceed to make the appointment.

b) Voting shall be by secret ballot.

c) An absolute majority of the votes cast shall be required at the first ballot and a relative majority at the second.

8. Term of office and possible re-appointment

a) The three senior officials shall henceforth be appointed for a period of five years.

b) Not less than six months before the expiry of the term of any such official, the procedure laid down in the preceding clauses shall be set in motion; the official may be put forward again as a candidate in accordance with clause 1, and his term may always be renewed for a period specified in advance by agreement between the Assembly and the Committee of Ministers in the Joint Committee.

RULES FOR CONSULTATIVE STATUS
[Resulution (72) 35 on relations between the Council
of Europe and international non-governmental
organisations adopted by the Committee of Ministers
on 16. October 1972.]

1. The Council of Europe may establish working relations with international non-governmental organisations by granting them consultative status.

2. For this purpose the Council of Europe shall draw up a list of international non-governmental organisations which are particularly representative in the field of their competence and,by their work in a given sector, are capable of contributing to the achievement of that closer unity mentioned in Article 1 of the Statute as the assigned aim of the Member States.

3. The organisations concernde shall undertake to:

a) give the maximum publicity to the initiatives or achievements of the Council of Europe in their own field of competence;

b) inform the Secretariat General of those of their activities likely to be of interest to the Council of Europe;

c) furnish information, documents or opinions relating to their own field of competence as requested by the Secretary General;

d) report periodically to the Secretary General with their diary of meetings and admit an observer from the secretariat to such meetings when so requested by the Secretary General.

4. The Committees of the Assembly, the Committees of governmental experts and other bodies of the Committee of Ministers, and the Secretary General may consult the organisations on questions of mutual interest.

5. The organisations:

a) may submit memoranda to the Secretary General who, if he sees fit, shall transmit them to a committee of the Consultative Assembly or a committee of governmental experts;

b) may be invited by an Assembly committee to express their views orally or in writing on a question included in that committee's agenda;

c) shall receive the agenda and public documents of the Assembly and be invited to send observes - without the right to speak -to public sitting of the Assembly.

6. The Secretary General shall keep a list of organisations enjoying consultative status with the Council of Europe.

7. Any organisation wishing to be entered on this list shallsend to the Secretary General of the Council of Europe an application accompanied by thirty copies of a file (in French or English) containing its Statute, a list of its member organisations, a report on its recent activities and declaration to the effect that it accepts the principles set out in the Preamble and Article 1 of the Statue of the Council of Europe.

8. Any organisation already on the list may be removed from it by the Secretary General if, in his opinion, it has failed to comply with its obligations under the rules set out in paragraphs 2,3 and 7 above, or if it is represented twice as a result of affiliation to a larger organisation which is itself on the list. However, the Secretary General shall first inform the organisation in question of his intention to remove it form the list, in order to give it an opportunity to pressent its observations.

9. Every six months the Secretary General shall inform the Committee of Ministers and the Consultative Assembly of the names of the organisations which he is considering adding to the list or removing from it, together with those items of the relevant files which are necessary for the assessment of each case and his reasons for suggesting they be added to the list or removed from it, having regard to the rules laid down in paragraphs 2,3 and 7 above; the Secretary General's memorandum concerning the removal of any organisation from the list shall also include any comments submitted by that organisation on the Secretary General's intention. In the absence of any objection as described in paragraph 10 below, the names of organisation that have thus been communicated shall be added to the list or removed from it, as the case may be, six months later.

10. During the six-months period, a member of the Committee of Ministers or three members of the Assembly of at least two different nationalities may request that an examination be made of the file of each organisation whose name has been communicated. In the former case, the examination shall be made and the decision to add the name to the list or to remove it from the list shall be taken by the Committee of Ministers. In the latter case, the Assembly, acting on a report from its competent committee, shall address a recommendation to the Committee of Ministers, which shall take a final decision. If an examination of the file of an organisation is requested both by a member of the Committee of Ministers and by therre members of the Assembly of at least two nationalities, the Committee of Ministers shall defer its decision until it has received a recommendation from the Assembly.

11. The procedure describen above shall not restrict the right of the Committee of Ministers or of the Assembly to initiate any action concernin other nongovernmental organisation in pursuance of their repsective Rules of procedure.

12. An organisation whose application has been refused or which has been removed from the list may not submit afresh application until three years have expired after the decision in question has been taken.

13. The organisations enjoying consultative status with the Council of Europe on the date of entry into force of these rules shall be entered on the new list of organisations granted consultative status with the Council of Europe referred to in paragraph 2 above, but may be subsequently removed from this list in accordance with these rules.

ALAPSZABÁLYA

A Belga Királyság, a Dán Királyság, a Francia Köztársaság, az Ír Köztársaság, az Olasz Köztársaság, a Luxemburgi Nagyhercegség, a Holland Királyság, a Norvég Királyság, a Svéd Királyság és Nagy-Britannia és Észak-Írország Egyesült Királyság kormánya,

Abban a meggyőződésben, hogy az igazságosságon és a nemzetközi együttműködésen alapuló béke megszilárdítása létfontosságú az emberi társadalom és a civilizáció fenntartása szempontjából;

Rendíthetetlenül ragaszkodván a népek közös örökségét alkotó szellemi és erkölcsi értékekhez, amelyek az egyéni szabadság, a politikai szabadság és a jog uralma igazi forrásai, olyan elveké, amelyek minden igazi demokrácia alapjául szolgálnak;

Abban a hitben, hogy ennek az eszménynek a fenntartása és fokozatos érvényre juttatása, valamint a gazdasági és szociális haladás előmozdítása érdekében, a hasonló felfogású európai országok között szorosabb egység kialakítására van szükség;

Tekintettel arra, hogy e szükségességnek és népeik kifejezett törekvéseinek megfelelőleg szükség van haladék nélkül egy olyan szervezet létrehozására, amely az európai országokat szorosabb szövetségbe fogja össze;

Következésképpen elhatározták az Európa Tanács létrehozását, amely kormányképviselők Bizottságából és a Tanácskozó Közgyűlésből áll és e célból elfogadták a jelen Alapszabályt.

I. fejezet

Az Európa Tanács célja

1. cikk

a) Az Európa Tanács célja, hogy szorosabb egységet teremtsen a tagjai között avégből, hogy biztosítsa és előmozdítsa a közös örökségüket alkotó eszményeket és elveket és könnyítse gazdasági és szociális haladásukat.

b) Erre a célra szolgál a Tanács szervei keretében a közös érdekű kérdések megtárgyalása, megállapodások kötése és közös lépések tétele gazdasági, szociális, kulturális, tudományos, jogi és igazgatási téren, valamint az emberi jogok és alapvető szabadságok fenntartása és fejlesztése terén.

c) A tagállamoknak az Európa Tanács munkájában való részvétele nem érinti az Egyesült Nemzetek Szervezetében és más olyan nemzetközi szervezetek tevékenységében való közreműködésüket, amelyeknek részesei.

d) A nemzeti védelem kérdései nem tartoznak az Európa Tanács hatáskörébe.

II. fejezet

A tagság

2. cikk

Az Európa Tanács tagállamai a jelen Alapszabály részesei.

3. cikk

Az Európa Tanács valamennyi tagállama elismeri a jog uralmának az elvét és azt az elvet, hogy a joghatósága alá tartozó minden személy részesül az emberi jogokban és az alapvető szabadságokban. Minden tagállam kötelezi magát, hogy őszintén és tevékenyen együttműködik az I. fejezetben meghatározott cél megvalósításában.

4. cikk

A Miniszterek Bizottsága meghívhat tagként az Európa Tanácsba minden olyan európai államot, amely képes és hajlandó elfogadni a 3. cikk rendelkezéseit. Minden, ily módon meghívott állam az Európa Tanács tagállama lesz, mihelyt a jelen Alapszabályhoz való csatlakozási okmányát a Főtitkárnál letétbe helyezte.

5. cikk

a) Különleges esetekben a Miniszterek Bizottsága meghívhat társult tagként az Európa Tanácsba minden olyan európai országot, amely képes és hajlandó teljesíteni a 3. cikk rendelkezéseit. Minden ily módon meghívott ország az Európa Tanács társult tagja lesz, mihelyt a jelen Alapszabályra vonatkozó elfogadási okmányát letétbe helyezte a Főtitkárnál. A társult tagok azonban csak a Tanácskozó Közgyűlésen képviseltethetik magukat.

b) A jelen Alapszabályban használt „tagállam” kifejezés magában foglalja a társult tagokat is azzal a kivétellel, hogy utóbbiak nem képviseltethetik magukat a Miniszterek Bizottságában.

6. cikk

Mielőtt a fenti 4. és 5. cikkben említett meghívást elküldené, a Miniszterek Bizottsága megállapítja azoknak a képviselőknek a számát, amelyre a javasolt tagállam a Tanácskozó Közgyűlésben jogosult lesz és az arányos pénzügyi hozzájárulásának mértékét.

7. cikk

A Főtitkárhoz intézett bejelentéssel bármely tagállamnak jogában áll az Európa Tanácsból kilépni. Amennyiben a bejelentés a folyó pénzügyi év első kilenc hónapja során történik, a kilépés ugyanazon év végén válik hatályossá. Ha a bejelentés a pénzügyi év utolsó három hónapjában történik, a kilépés a következő pénzügyi év végén lép hatályba.

8. cikk

Amennyiben az Európa Tanács egy tagállama súlyosan megsérti a 3. cikk rendelkezéseit, képviseleti joga felfüggeszthető, és a Miniszterek Bizottsága felkérheti, hogy a 7. cikkben foglaltak szerint jelentse be kilépését. Ha az illető tagállam a felszólításnak nem tesz eleget a Bizottság elhatározhatja, hogy az illető állam tagsága a Bizottság által megállapított időpontban megszűnt.

9. cikk

Ha valamely tagállam nem tesz eleget pénzügyi kötelezettségének, a Miniszterek Bizottsága felfüggesztheti a Bizottságban és a Tanácskozó Közgyűlésen való képviseleti jogát addig, ameddig az említett kötelezettségét nem teljesíti.

III. fejezet

Általános rendelkezések

10. cikk

Az Európa Tanács szervei:

(i) a Miniszterek Bizottsága

(ii) a Tanácskozó Közgyűlés.

Mindkét szervnek az Európa Tanács Titkársága segédkezik.

11. cikk

Az Európa Tanács székhelye Strasbourg.

12. cikk

Az Európa Tanács hivatalos nyelve angol és francia. A Miniszterek Bizottsága és a Tanácskozó Közgyűlés ügyrendje határozza meg az egyéb nyelvek használatának körülményeit és feltételeit.

IV. fejezet

A Miniszterek Bizottsága

13. cikk

A Miniszterek Bizottsága az az illetékes szerv, amely az Európa Tanács nevében a 15. és 16. cikknek megfelelően eljár.

14. cikk

Minden tagállam egy képviselőt küldhet a Miniszterek Bizottságába és minden képviselő egy szavazati joggal rendelkezik. A Miniszterek Bizottsága tagjai a tagállamok külügyminiszterei. Akadályoztatása esetén, vagy ha azt egyéb körülmények indokolják, helyébe helyettes jelölhető ki, aki - ha csak lehetséges - a Kormány tagja legyen.

15. cikk

a) A Miniszterek Bizottsága a Tanácskozó Közgyűlés javaslatára vagy saját kezdeményezésére megvizsgálja az Európa Tanács célja előmozdítására alkalmas lépéseket, ideértve szerződések és megállapodások kötését és meghatározott kérdésekre vonatkozólag a Kormányok részéről közös politika elfogadását. Döntéseiről a főtitkár tájékoztatja a tagállamokat.

b) Adott esetben a Miniszterek Bizottsága döntései ajánlás formájában továbbíthatók a kormányokhoz. A Bizottság felhívhatja a tagállamok kormányait, hogy értesítsék az ajánlás alapján tett lépésekről.

16. cikk

A Miniszterek Bizottsága - a 24., 28., 30., 32., 33. és 35. cikkekben a Tanácskozó Közgyűlésnek fenntartott hatáskörök érintése nélkül - kötelező érvénnyel dönt az Európa Tanács minden belső szervezeti és elrendezési kérdésében. Ennek érdekében, szükség szerint pénzügyi és szervezeti szabályzatot fogad el.

17. cikk

A Miniszterek Bizottsága tanácsadó és szakértői bizottságokat és testületeket küldhet ki meghatározott célokra, saját belátása szerint.

18. cikk

A Miniszteri Bizottság megállapítja ügyrendjét, amely egyebek között, a következőket határozza meg:

(i) a határozatképességet;

(ii) az Elnök kinevezésének módját és megbízatásának időtartamát;

(iii) a napirend összeállításának, valamint a határozati javaslatok benyújtásának módját; és

(iv) a 14. cikknek megfelelően kijelölt helyettesek bejelentésének módját.

19. cikk

A Miniszterek Bizottsága a Tanácskozó Közgyűlésnek minden ülésszakán benyújtja a tevékenységéről készült jelentéseket, csatolva hozzá a megfelelő dokumentumokat.

20. cikk

a) A Miniszterek Bizottsága határozatait a szavazó képviselők egyhangú szavazatával és a Bizottságban helyet foglalni jogosult képviselők többségével hozza meg az alább felsorolt fontos ügyekben:

(i) a 15. b) cikk alatti ajánlások;

(ii) a 19. cikk alatti kérdések;

(iii) a 21. cikk a) és b) cikk alatti kérdések;

(iv) a 33. cikk alatti kérdések;

(v) az 1. d), 7., 15., 20. és 22. cikk módosítására vonatkozó ajánlások; és

(vi) minden olyan más kérdés, amelyre vonatkozólag a bizottság - az alanti d) bekezdésnek megfelelően - úgy határoz, hogy abban - fontosságára tekintettel - egyhangú szavazásra van szükség.

b) Az ügyrendet, illetve a pénzügyi és szervezeti szabályzatot érintő kérdésekről a Bizottságban helyet foglalni jogosult képviselők egyszerű többségi szavazással hozhatnak határozatot.

c) A Bizottság 4. és 5. cikk szerinti határozatait a Bizottságban helyet foglalni jogosult képviselők kétharmados szótöbbséggel fogadják el.

d) A Bizottság minden egyéb határozatát a leadott szavazatok kétharmados többségével és a Bizottságban helyet foglalni jogosult képviselők kétharmados többségével hozza, ideértve a költségvetés elfogadására, az ügyrendre, a pénzügyi és szervezeti szabályzatra, a jelen Alapszabályzat Cikkeinek a fenti a) (v) bekezdésében nem említett módosítását célzó ajánlásokat, és az arra vonatkozó határozatokat, hogy kétség esetében ennek a Cikknek melyik bekezdése alkalmazandó.

21. cikk

a) Amennyiben a Miniszterek Bizottsága másképp nem dönt, a Bizottság tanácskozásait:

(i) a nyilvánosság kizárásával,

(ii) a Tanács székhelyén tartja.

b) A Miniszterek Bizottsága dönti el, hogy milyen tájékoztatás adható a nyilvánosság kizárásával folytatott tanácskozásról.

c) A Miniszterek Bizottsága kötelező módon ülést tart a Tanácskozó Közgyűlés minden ülésszakának megnyitása előtt és az ülésszakok kezdetén; továbbá ülést tarthat, valahányszor azt szükségesnek ítéli meg.

V. fejezet

A Tanácskozó Közgyűlés

22. cikk

A Tanácskozó Közgyűlés az Európa Tanács tanácskozó testülete. Megvitatja a jelen Alapszabály értelmében hatáskörébe tartozó kérdéseket, és állásfoglalásait ajánlás formájában a Miniszterek Bizottsága elé terjeszti.

23. cikk

a) A Tanácskozó Közgyűlés tanácskozhat és ajánlásokat tehet minden olyan kérdésről, amely megfelel az Európa Tanács minden céljának és annak hatáskörébe tartozik az I. fejezetben foglaltak szerint. A Tanácskozó Közgyűlés tárgyalhat és ajánlást tehet minden olyan kérdés kapcsán, amelyet véleménye kikérése végett a Miniszteri Bizottság terjesztett be hozzá.

b) A Tanácskozó Közgyűlés a fenti a) bekezdés rendelkezéseinek megfelelően állapítja meg napirendjét az olyan európai kormányközi szervezetek tevékenységének figyelembevételével, amelyeknek a Tanács valamennyi vagy néhány tagállama is tagja.

c) Kétség esetében a Közgyűlés Elnöke dönti el, hogy az ülésszak során felmerült valamely kérdés a Közgyűlés napirendjének keretébe tartozik-e.

24. cikk

A Tanácskozó Közgyűlés, figyelembe véve a 38. cikk d) rendelkezéseit, bizottságokat létesíthet a 23. cikkben meghatározott hatáskörébe tartozó valamennyi kérdés vizsgálatára, jelentések készítésére, a napirendjére tűzött ügyek tanulmányozására, továbbá minden ügyrendi kérdésre vonatkozó javaslat tételére.

25. cikk

a) A Tanácskozó Közgyűlés a tagországok képviselőiből áll, akiket az érintett parlamentek választanak meg saját parlamenti képviselőik közül, vagy akiket a parlament által megállapított eljárás szerint a parlamenti képviselők neveznek ki azzal a fenntartással, hogy minden tagállam kormánya is eszközölhet további kinevezéseket abban az esetben, ha a parlament éppen nem ülésezik és nem állapította meg az ebben az esetben követendő kinevezési eljárást. Minden képviselőnek annak a tagállamnak az állampolgárságával kell bírnia, amelyet képvisel. A képviselő nem lehet egyidejűleg a Miniszterek Bizottságának is tagja.

Az ily módon kinevezett képviselők mandátuma a kinevezésüket követő rendes ülésszak megnyitásával lép életbe és csak a következő rendes ülésszak vagy egy későbbi rendes ülésszak megnyitásakor jár le, kivéve, hogy a tagországok, parlamenti választások esetében, új kinevezések tételére válnak jogosulttá.

Amennyiben egy tagállam betölti az elhalálozás vagy lemondás miatt megüresedett helyeket, vagy parlamenti választások következtében újabb kinevezéseket eszközöl, az új képviselők mandátuma a Közgyűlésnek a kinevezésüket követő első ülésén lép életbe.

b) A Közgyűlés ülésszaka alatt a Közgyűlés hozzájárulása nélkül egyetlen képviselőt sem lehet mandátumától megfosztani.

c) Minden képviselőnek lehet helyettese, aki távollétében helyette ülésezik, felszólal és szavaz. A fenti a) bekezdés rendelkezései a helyettesek kinevezésére is vonatkoznak.

26. cikk

A tagállamok a következő számú képviselőt küldhetik:

27. cikk

Annak a feltételeit, hogy miként történjék a Miniszterek Bizottsága kollektív képviselete a Tanácskozó Közgyűlésen, illetve, hogy miként szólalhatnak fel ott a Bizottság egyes tagjai és helyetteseik, a Bizottság által - a Közgyűléssel való konzultálás után - szövegezett ügyrend erre vonatkozó rendelkezései határozzák meg.

28. cikk

a) A Tanácskozó Közgyűlés megállapítja ügyrendjét és tagjai közül megválasztja Elnökét, aki a legközelebbi rendes ülésszakig marad hivatalban.

b) Az Elnök irányítja a Tanácskozó Közgyűlés munkáját, de a vitában és a szavazásban nem vesz részt. Annak a képviselőnek, aki elnök lett, a helyettese jogosult az elnök helyében ülésezni, szót kérni és szavazni.

c) Az ügyrend határozza meg egyebek között:

(i) a határozatképességet;

(ii) az Elnök, valamint a többi tisztségviselő választásának módját és megbízatásuk időtartamát;

(iii) a napirend összeállításának módját és a képviselők arról való tájékoztatását;

(iv) a képviselők és helyetteseik nevei közzétételének időpontját és módját.

29. cikk

A 30. cikk rendelkezéseinek fenntartásával a Tanácskozó Közgyűlés minden határozatát a leadott szavazatok kétharmados többségével hozza, ideértve azokat a határozatokat, amelyek tárgya a következő:

(i) ajánlások tétele a Miniszterek Bizottságának;

(ii) javaslattétel a Bizottságnak a Közgyűlés napirendjére felírandó kérdéseket illetően;

(iii) bizottságok létrehozása;

(iv) az ülésszak megnyitási időpontjának megállapítása;

(v) annak meghatározása, hogy a fenti (i)-(iv) pontokba nem tartozó egyéb határozatok elfogadásához milyen szavazati többség szükséges, vagy kétes esetekben milyen többség a megfelelő.

30. cikk

A Tanácskozó Közgyűlésnek azokat a határozatait, amelyek belső ügyrendjére, nevezetesen a tisztségviselők megválasztására, a bizottságok tagjainak kinevezésére és az Ügyrendi Szabályzat jóváhagyására vonatkoznak, azzal a szótöbbséggel hozza meg, amelyet a Közgyűlés a 29. cikk (v) pontjának megfelelően határoz meg.

31. cikk

Azokat a vitákat, amelyek valamely kérdésnek a Tanácskozó Közgyűlés napirendjére tűzésével kapcsolatosak, a tárgy meghatározására és a napirendre tűzés mellett és ellene szóló érvekre kell korlátozni.

32. cikk

A Tanácskozó Közgyűlés évente egy rendes ülésszakot tart, amelynek időpontját és időtartamát a Közgyűlés oly módon állapítja meg, hogy lehetőleg kerülje az átfedést a tagállamok parlamenti ülésszakaival és az Egyesült Nemzetek Szervezete Közgyűlésének ülésszakaival. A rendes ülésszak időtartama nem haladhatja meg az egy hónapot, kivéve, ha a Közgyűlés és a Miniszterek Bizottsága közös megegyezés alapján másként nem dönt.

33. cikk

A Tanácskozó Közgyűlés rendes ülésszakait a Tanács székhelyén tartja, kivéve, ha a Közgyűlés és a Miniszteri Bizottság másként nem dönt.

34. cikk

A Tanácskozó Közgyűlés rendkívüli ülésszakra is összehívható, a Miniszterek Bizottsága vagy a Közgyűlés elnökének kezdeményezésére, közös megegyezésük alapján, amely megegyezés az ülésszak időpontjának és helyének meghatározására is kiterjed.

35. cikk

A Tanácskozó Közgyűlés vitái nyilvánosak, hacsak az másképp nem dönt.

VI. fejezet

A Titkárság

36. cikk

a) A Titkárság Főtitkárból, Főtitkárhelyettesből és a szükséges személyzetből áll.

b) A Főtitkárt és a Főtitkárhelyettest a Miniszterek Bizottsága javaslatára a Tanácskozó Közgyűlés nevezi ki.

c) A Titkárság többi tagját, a szervezeti szabályzatnak megfelelően, a Főtitkár nevezi ki.

d) A Titkárság tagjai egyetlen kormánynál sem viselhetnek semmilyen fizetett hivatalt, nem lehetnek a Tanácskozó Közgyűlés vagy egy nemzeti parlament tagjai és nem folytathatnak feladataikkal össze nem egyeztethető tevékenységet.

e) A Titkárság minden tagjának ünnepélyes nyilatkozatot kell tennie, amelyben kifejezi az Európa Tanács iránti elkötelezettségét és ígéri, hogy feladatait lelkiismeretesen, semmiféle nemzeti meggondolás által befolyásolni magát nem engedvén fogja végezni, továbbá hivatalának gyakorlása közben nem kéri és nem fogadja el egyetlen kormány vagy az Európa Tanácson kívüli bármely hatóság utasításait, és tartózkodik minden olyan cselekedettől, amely összeegyeztethetetlen lenne a kizárólag az Európa Tanácsnak felelős nemzetközi tisztviselő minőségével. A Főtitkár és a Főtitkárhelyettes a Bizottság előtt, a személyzet tagjai pedig a Főtitkár előtt teszik meg ezt a nyilatkozatukat.

f) Minden tagállamnak tiszteletben kell tartania a Főtitkár és a Titkárság személyzetének kizárólagosan nemzetközi jellegét, és tartózkodnia kell attól, hogy őket hivataluk gyakorlása közben befolyásolják.

37. cikk

a) A Titkárság a Tanács székhelyén működik.

b) A Főtitkár a Titkárság tevékenységéért a Miniszterek Bizottságának felelős. A 38. cikk d) bekezdése rendelkezéseinek fenntartása mellett a Főtitkár biztosítja a Tanácskozó Közgyűlés számára az adminisztratív és egyéb olyan szolgáltatásokat, amelyekre az igényt tart.

VII. fejezet

Pénzügyek

38. cikk

a) Minden tagállam maga viseli a Miniszterek Bizottságában és a Tanácskozó Közgyűlésen való képviseletének költségeit.

b) A Titkárság kiadásai és az egyéb közös kiadások abban az arányban oszlanak meg a tagállamok között, amelyet a Bizottság állapít meg az egyes tagországok népességének a száma szerint.

A társult tagok hozzájárulását a Bizottság állapítja meg.

c) A pénzügyi szabályzatnak megfelelően a Tanács költségvetését a Főtitkár jóváhagyás végett minden évben a Bizottság elé terjeszti.

d) A Főtitkár a Bizottsághoz továbbítja a Közgyűlésnek azokat a kívánságait, amelyek a költségvetésben a Közgyűlés és tevékenysége részére megállapított összeget meghaladó kiadásokkal járnak.

e) A Főtitkár továbbá a Miniszterek Bizottságához költségbecslést nyújt be a Bizottsághoz beterjesztett valamennyi ajánlás pénzügyi kihatásairól. Az a határozat, amelynek végrehajtása többletkiadásokat igényel, csak akkor tekinthető elfogadottnak, ha a Miniszterek Bizottsága jóváhagyta az erre vonatkozó előre látható többletköltségeket.

39. cikk

A Főtitkár minden évben tájékoztatja a tagországok kormányait hozzájárulásuk összegéről. A hozzájárulás esedékesnek tekinthető az értesítés napján, és azt a Főtitkárhoz legkésőbb hat hónapon belül be kell fizetni.

VIII. fejezet

Kiváltságok és mentességek

40. cikk

a) Az Európa Tanács, a tagállamok képviselői és a Titkárság a tagállamok területén a feladatuk ellátásához szükséges kiváltságokkal és mentességekkel rendelkeznek. Ezek a mentességek magukban foglalják a Tanácskozó Közgyűlés képviselőinek azt a mentességét, hogy a tagállamok területén nem tartóztathatók le, és ellenük bírósági eljárás nem indítható a Közgyűlés és annak bizottságaiban lezajlott viták során nyilvánított véleményük vagy szavazatuk miatt.

b) A tagállamok vállalják, hogy a lehető legrövidebb időn belül Egyezményt írnak alá a fenti a) bekezdés rendelkezéseinek végrehajtása céljából. Ennek érdekében a Miniszterek Bizottsága ajánlani fogja a tagállamok kormányainak a területükön biztosítandó kiváltságokat és mentességeket meghatározó megállapodás megkötését. Ezen kívül a Francia Köztársaság kormányával külön kötendő megállapodásban meg kell határozni azokat a kiváltságokat és mentességeket, amelyekben az Európa Tanács a székhelyén részesül.

IX. fejezet

Módosítások

41. cikk

a) A jelen Alapszabályra vonatkozó módosítási javaslatokat a Miniszterek Bizottságában, vagy a 23. cikkben leírt feltételek mellett, a Tanácskozó Közgyűlésen lehet megtenni.

b) A Bizottság az Alapszabálynak azokat a módosításait, amelyeket kívánatosnak tart, jegyzőkönyvbe foglaltatja és ajánlja.

c) Minden módosítási jegyzőkönyv azután lép életbe, miután azt a tagállamok kétharmada aláírta és megerősítette.

d) A jelen cikk előző bekezdésében foglalt rendelkezések ellenére, a Bizottság és Közgyűlés által jóváhagyott, a 23-35., 38. és 39. cikkekre vonatkozó módosítások a Főtitkár által kiállított és a tagországok kormányainak átadott, a fent említett módosítások jóváhagyását igazoló tanúsítvány keltének napján lépnek életbe. A jelen bekezdés rendelkezései csak a Közgyűlés második rendes ülésszakának vége után alkalmazhatók.

X. fejezet

Záró rendelkezések

42. cikk

a) A jelen Alapszabályt meg kell erősíteni. A megerősítő okiratokat Nagy-Britannia és Észak-Írország Egyesült Királyság kormányánál kell letétbe helyezni.

b) A jelen Alapszabály hét megerősítő okirat letétbe helyezése után lép hatályba. Az Egyesült Királyság kormánya értesíti valamennyi aláíró kormányt az Alapszabály hatálybalépéséről, közölvén az adott napra vonatkozóan az Európa Tanács tagállamainak a nevét.

c) Minden további aláíró ezt követően a megerősítő okirata letétbe helyezésének napjától kezdődően válik az Alapszabály részesévé.

A fentiek hiteléül az erre nézve kellően felhatalmazottak a jelen Alapszabályt aláírták.

Kelt Londonban, az 1949. évi május hó 5. napján angol és francia nyelven, mindkét szöveg egyaránt hiteles, egyetlen példányban, amely Nagy-Britannia és Észak-Írország Egyesült Királyság kormánya irattárában marad, amely minden aláíró kormánynak hitelesített másolatokat juttat el.

Alapszabályszerű határozatok

I.

A Miniszterek Bizottsága által nyolcadik ülésszaka során hozott határozat 1951 májusa

A Miniszterek Bizottsága

Tekintettel a Tanácskozó Közgyűlés által az Európa Tanács Alapszabályának felülvizsgálatára vonatkozóan előterjesztett bizonyos javaslatokra;

Megállapítván, hogy az alább említett intézkedések nem mondanak ellent a jelen Alapszabály rendelkezéseinek;

Kinyilatkoztatja a következő rendelkezések hatálybaléptetésére irányuló szándékát:

Új tagállamok felvétele

A Miniszterek Bizottsága, mielőtt felkérne egy államot, hogy az Alapszabály 4. és 5. cikke rendelkezéseinek megfelelően tagállamként vagy társult tagként csatlakozzék az Európa Tanácshoz, illetve, mielőtt a 8. cikk rendelkezéseinek megfelelően kilépésre szólítaná fel az Európa Tanács valamely tagállamát, először is a jelenlegi gyakorlatnak megfelelően, konzultál a Tanácskozó Közgyűléssel.

A Miniszterek Bizottságának hatásköre

(Az Alapszabály 15. cikke)

A Bizottság adott esetben döntéseit egyezmény vagy megállapodás formájában hozza meg. Ilyen esetben a következő rendelkezések alkalmazandók:

(i) A Főtitkár az egyezményt vagy megállapodást valamennyi tagországnak átadja megerősítés céljából;

(ii) Valamennyi tagország vállalja, hogy az átadást követő egy éven belül, vagy amennyiben ez különleges körülmények miatt nem lehetséges, 18 hónapon belül beterjeszti az egyezmény vagy megállapodás megerősítése kérdését az országok illetékes hatóságához vagy hatóságaihoz;

(iii) A megerősítő okiratokat a Főtitkárnál kell letétbe helyezni;

(iv) Az egyezmény vagy megállapodás csak az azt megerősítő tagállamokra nézve kötelező.

Közös Bizottság

(i) A Közös Bizottság az Európa Tanács koordinációs szerve. A Miniszterek Bizottsága és a Tanácskozó Közgyűlés jogainak sérelme nélkül a Közös Bizottság feladatai egyebek között a következők:

a) megvizsgálja a két említett szerv közös problémáit;

b) felhívja a két szerv figyelmét azokra a kérdésekre, amelyek az Európa Tanács különös érdeklődésére tarthatnak számot;

c) javaslatokat tesz a Miniszterek Bizottsága és a Tanácskozó Közgyűlés napirendi tervezetére nézve;

d) megvizsgálja és támogatja azokat az intézkedéseket, amelyek előmozdíthatják a két szerv egyike vagy másika által jóváhagyott javaslatok gyakorlati megvalósítását;

(ii) a) A Közös Bizottság elvileg tizenkét tagból áll, akik közül öten a Miniszterek Bizottságát, heten pedig a Tanácskozó Közgyűlést képviselik. Az utóbbiak között van a Tanácskozó Közgyűlés elnöke is, aki hivatalból tag.

A tagok száma a Miniszterek Bizottsága és a Közgyűlés között létrejött közös megegyezés alapján növelhető. A Miniszterek Bizottsága azonban jogosult saját képviselőinek számát egy vagy két taggal növelni.

b) A Miniszterek Bizottságára és a Tanácskozó Közgyűlésre tartozik, hogy miként határozzák meg saját képviselőiknek a Közös Bizottságba való kijelölése módját.

c) A Főtitkár tanácskozási joggal vehet részt a Közös Bizottság ülésein.

(iii) a) A Közös Bizottság elnöki tisztét a Tanácskozó Közgyűlés elnöke látja el.

b) A Közös Bizottság csak akkor tanácskozhat érvényesen, ha a Miniszterek Bizottságának legalább három és a Tanácskozó Közgyűlés legalább öt képviselője jelen van.

c) A Közös Bizottság döntéseit szavazás nélkül hozza.

d) A Közös Bizottságot az elnök hívja össze és üléseit a szükséges gyakorisággal tartja, különösen a Miniszterek Bizottsága és a Tanácskozó Közgyűlés ülésszakai előtt és után.

e) A Közös Bizottság - az előbbi rendelkezések érintése nélkül - saját ügyrendet fogadhat el.

Szakosított Szervek

(i) a) Az Európa Tanács a tagállamok között tárgyalásokat kezdeményezhet Európai Szakosított Szervek létrehozásáról, amelyek mindegyikének saját szakterülete lenne gazdasági, szociálpolitikai, kulturális, jogi, közigazgatási vagy egyéb kapcsolatos területen.

b) A tagállamok mindegyike szabadon határoz arról, hogy valamely Európai Szakosított Szervhez csatlakozik-e vagy sem.

(ii) Amennyiben a tagállamok saját kezdeményezésükre maguk között Európai Szakosított Szerveket hoznak létre, meg kell vizsgálni, hogy kívánatos-e kapcsolatot létesítenie ezen Szervek és az Európa Tanács között, az európai közösség egésze érdekeinek kellő módon történő figyelembevételével.

(iii) a) A Miniszterek Bizottsága bármelyik Szervet felkérheti, hogy küldjön neki időszakos jelentéseket a tevékenységéről.

b) Amennyiben a Szakosított Szervet létrehozó megállapodás parlamenti testület létesítéséről rendelkezik, ez a parlamenti testület felkérhető, hogy nyújtson be időszakos jelentéseket az Európa Tanács Tanácskozó Közgyűléséhez.

(iv) a) Az Európa Tanács és az Európai Szakosított Szerv között megkötött különleges megállapodások határozzák meg azokat a feltételeket, amelyek mellett az adott Szakosított Szerv kapcsolódik az Európa Tanácshoz. Ezek a megállapodások egyebek között a következőkre vonatkozhatnak:

1. kölcsönös képviselet és adott esetben megfelelő integrációs formák az Európa Tanács szervei és a Szakosított Szerv között;

2. információk, dokumentációk és statisztikai adatok cseréje;

3. a Szakosított Szervek jelentései az Európa Tanácshoz, és az Európa Tanács ajánlásai a Szakosított Szervekhez;

4. a személyzetet és az adminisztratív, technikai, költségvetési és pénzügyi szolgálatokat érintő megegyezések.

b) Ezeket a megállapodásokat az Európa Tanács nevében a Miniszterek Bizottsága tárgyalja és köti meg, miután a Tanácskozó Közgyűlés azokról véleményt nyilvánított.

(v) Az Európa Tanács a fenti rendelkezések értelmében összehangolhatja a Tanáccsal kapcsolatban álló Szakosított Szervek tevékenységét, közös megbeszéléseket folytatva velük, ajánlásokat téve nekik, továbbá ajánlásokat téve a tagállamok kormányainak.

Kapcsolatok a nemzetközi kormányközi és nem-kormányközi szervezetekkel

(i) A Miniszterek Bizottsága az Európa Tanács nevében megállapodásokat köthet bármely kormányközi szervezettel az Európa Tanács hatáskörébe tartozó ügyekben. Ezek a megállapodások határozzák meg nevezetesen azt, hogy az adott szervezet és az Európa Tanács milyen feltételek mellett létesítenek egymással kapcsolatot.

(ii) Az Európa Tanács vagy bármely szerve jogosult az olyan, az Európa Tanács hatáskörébe illő feladat ellátására, amellyel más európai kormányközi szervezetek bízzák meg. A Miniszterek Bizottsága köti meg az ezzel kapcsolatban szükséges megállapodásokat.

(iii) Az (i) bekezdésben említett megállapodás egyebek között úgy rendelkezhet:

a) hogy a Tanács minden szükséges intézkedést megtesz annak érdekében, hogy az említett szervezetektől rendszeres jelentéseket és információkat kapjon és nekik hasonlókat nyújtson akár írásban, akár szóban;

b) hogy a Tanács véleményt nyilvánít és szolgáltatásokat nyújt e szervezetek kérelmének megfelelően.

(iv) A Miniszterek Bizottsága az Európa Tanács nevében minden szükséges lépést megtehet az olyan kormányközi és nem-kormányközi szervezetekkel való konzultálás végett, amelyek az Európa Tanács hatáskörébe tartozó kérdésekkel foglalkoznak.

II.

Részleges megállapodások

A Miniszterek Bizottsága által a kilencedik ülésszakon hozott határozat 1951 augusztusa

A Miniszterek Bizottsága

Tekintettel az Alapszabály 20. cikkének a) bekezdésére, amely szerint a Miniszterek Bizottsága által a tagállamok kormányaihoz intézett ajánlások elfogadásához a szavazó képviselők egyhangú szavazata és a bizottságban helyet foglalni jogosult képviselők többsége szükséges;

Tekintettel a Tanácskozó Közgyűlés által 1950 augusztusában jóváhagyott 3. Ajánlásra;

Törekedvén arra, hogy amilyen gyakran csak lehet, a döntéseket egyhangúlag hozzák, elismervén ugyanakkor, hogy bizonyos körülmények között egyes tagállamok tartózkodni kívánnak a mások által javasolt irányvonaltól;

Megállapítván, hogy e célból kívánatos az Alapszabály 20. cikke a) bekezdésében már jóváhagyott tartózkodási gyakorlatot oly módon pontosítani, hogy a Miniszterek Bizottsága egyes képviselőinek joga van kormányának képviselőtársai által elfogadott döntés iránti elkötelezését oly módon elkerülni, hogy tartózkodik a javaslat feletti szavazástól;

Elhatározza:

1. Ha a Bizottság a szavazó képviselők egyhangú szavazatával és a Bizottságban helyet foglalni jogosult képviselők többségével elhatározza, hogy valamely eléje terjesztett javaslatra nézve megengedett legyen a szavazástól való tartózkodás, akkor ezt a javaslatot a Bizottság elé kell terjeszteni; a javaslatot csak azoknak a képviselőknek a részéről kell elfogadottnak tekinteni, akik azt megszavazták, és alkalmazása is ennek megfelelően korlátozódik.

2. Minden többletkiadást, amely a fenti eljárással elfogadott javaslatok következményeképpen a Tanácsra hárul, kizárólag azoknak a tagoknak kell viselniük, amelyek képviselői a javaslatra szavaztak.

A Főtitkár, a Főtitkárhelyettes és a Közgyűlés Jegyzőjének kinevezésére vonatkozó Szabályzat

1. A jelölések benyújtása

a) Abban az esetben, ha a Főtitkárság három legmagasabb, a Miniszterek Bizottsága javaslatára a Tanácskozó Közgyűlés által betöltendő állásának egyikében üresedés áll be, vagy az alábbi 8. cikk b) bekezdése esetében

(i) egy vagy több tagállam kormánya;

(ii) a Főtitkárhelyettes és a Közgyűlés Jegyzője állására nézve a Főtitkár jelölési javaslatot tehet a Miniszterek Bizottságának.

Továbbá, a Tanácskozó Közgyűlés Jegyzője állásának megüresedésekor vagy az alábbi 8. cikk b) bekezdése esetén a Tanácskozó Közgyűlés egy vagy több képviselőcsoportja is tehet javaslatot a Miniszterek Bizottságának; a javaslatokat legalább öt, és legfeljebb tíz aláírással kell ellátni.

A Főtitkár csak olyan jelölteket javasolhat, akik már állandó vagy ideiglenes jelleggel a Főtitkár alkalmazottai.

A Főtitkár alkalmazottainak jelölését egy vagy több kormány ugyancsak támogathatja, feltéve, hogy a Főtitkárhelyettes és a Tanácskozó Közgyűlés Jegyzője esetében a Főtitkár véleményét előre kikérték és ő a beleegyezését adta.

b) A tagállamok kormányai és a Tanácskozó Közgyűlés képviselői javaslataikat a Főtitkárhoz juttatják el, aki azokat saját javaslataival egyetemben a Miniszterek Bizottságához továbbítja.

2. A jelöltek kiválasztását meghatározó tényezők

A jelöltek kiválasztását meghatározó tényezők a következők:

a) Kiemelkedő szaktekintéllyel és feddhetetlenséggel, valamint a betöltendő állásnak megfelelő képességekkel rendelkező személyek kiválasztása.

b) Az Európa Tanácsnál már alkalmazásban álló személyek képzettségének és tapasztalatainak figyelembevétele, hogy ezáltal a Titkárság alkalmazottainak ésszerű előmeneteli lehetőségei legyenek.

c) A betöltendő állások méltányos földrajzi elosztásának szükségessége a tagállamok között, figyelembe véve mindenekelőtt a hatékonyság fontosságát. A Titkárság egyetlen hivatalára sem lehet valamely tagállamnak előjoga.

3. A jelölések előzetes megvizsgálása a Miniszterek Bizottsága által

A Miniszterek Bizottsága megvizsgálja a jelöltek listáját. A Bizottság vagy egy erre a célra kinevezett albizottság személyes beszélgetésre hívhatja be a jelölteket.

4. A Miniszterek Bizottságának tanácskozása a Közgyűléssel

A Miniszterek Bizottsága, mielőtt a Főtitkárság három vezető állása egyikének betöltésével kapcsolatos ajánlásait benyújtaná a Tanácskozó Közgyűlésnek, a Közös Bizottság közvetítésével tanácskozik a Közgyűléssel.

Erre a tanácskozásra, hacsak a Közös Bizottság másképp nem dönt, legalább harminc nappal annak az ülésszaknak a megnyitása előtt kerül sor, amelynek során a Közgyűlés a kinevezést megejti.

5. A jelöltek állítása

a) Amennyiben a Közös Bizottságban másképp nem döntenek, a Miniszterek Bizottsága összeállít egy, legalább két nevet tartalmazó listát, amelyet a Közgyűléshez nyújt be.

b) A Főtitkár és a Főtitkárhelyettes állására való jelölések esetén a Miniszterek Bizottsága, amennyiben úgy kívánja, a jelöltek listáját elsőbbségi sorrendben állíthatja össze.

6. Eljárási rend a Vezetőségben

A Miniszterek Bizottsága által a Közgyűléshez benyújtott javaslatokat a Vezetőség vizsgálja meg, és a jelölteket beszélgetésre hívhatja be. Azután a javaslatokat átadja a Közgyűlésnek, jelezvén - ha úgy találja helyesnek és megfelelőnek -, a jelöltek között a saját elsőbbségi sorrendjét és a Miniszterek Bizottságának elsőbbségi sorrendjét.

7. Eljárási rend a Közgyűlésen

a) A Közgyűlés megejti a jelölést.

b) A szavazás titkosan történik.

c) A szavazás első fordulójában a leadott szavazatok abszolút többsége, a második fordulóban relatív többsége szükséges.

8. A kinevezés időtartama és esetleges megújítása

a) A három magas állásra a kinevezés ezentúl ötéves időtartamra szól.

b) Az ilyen tisztviselő alkalmazásának lejárta előtt legkésőbb hat hónappal meg kell indítani az előző bekezdésekben előirányzott eljárásokat. Az illető tisztviselő jelölése az 1. bekezdésnek megfelelően újra előterjeszthető és megbízatása mindig megújítható a Közgyűlés és a Miniszterek Bizottsága között a Közös Bizottságban létrejött megállapodásban előre meghatározott időtartamra.

A tanácskozói státus szabályzata

(A Miniszterek Bizottsága által 1972. október 16-án hozott (72)35. számú határozat az Európa Tanács és a nem-kormányközi szervezetek között fennálló kapcsolatokról)

1. Az Európa Tanács munkakapcsolatot létesíthet a nem-kormányközi nemzetközi szervezetekkel, tanácskozó státust biztosítva számukra.

2. E célból az Európa Tanács összeállítja azoknak a nem-kormányközi szervezeteknek a jegyzékét, amelyek saját szakterületükön különösen elismertek, és amelyek egy meghatározott területen folytatott tevékenységük révén alkalmasak arra, hogy hozzájáruljanak az Európa Tanács tagállamai közötti szorosabb egység megvalósításához, amint azt a tagországok az Alapszabály 1. cikkében célul tűzték ki.

3. Az érintett szervezetek kötelezik magukat, hogy:

a) a lehető legnagyobb nyilvánosságot biztosítják szakterületükön az Európa Tanács kezdeményezéseinek, illetve azok megvalósításának;

b) tájékoztatják a Főtitkárságot minden olyan tevékenységükről, amely az Európa Tanács érdeklődésére tarthat számot;

c) megadják azokat a szakterületükkel kapcsolatos információkat, dokumentációkat és véleményezéseket, amelyeket a Főtitkár esetleg kér tőlük;

d) rendszeres időszakonként tájékoztatják a Főtitkárt azokról a lépésekről, amelyeket az a) bekezdésben vállalt kötelezettségük vonatkozásában tettek;

e) ismertetik a Főtitkárral értekezleteik időbeosztását, és a Főtitkár kérésére hozzájárulnak ahhoz, hogy azokon a Főtitkárság megfigyelője részt vegyen.

4. A Közgyűlés Bizottságai, a kormányok szakértői bizottságai, a Miniszterek Bizottságának egyéb segédszervei és a Főtitkár tanácskozhatnak e szervezetekkel a közös érdeklődésre számottartó kérdésekről.

5. A szervezetek

a) emlékeztetőket nyújthatnak be a Főtitkárhoz, aki, amennyiben célszerűnek véli, továbbítja azokat a Tanácskozó Közgyűlés valamely bizottságához vagy egy kormányszintű szakértői bizottsághoz;

b) felkérhetők a Közgyűlés bizottságai által, hogy fejtsék ki szóban vagy írásban az e bizottságok napirendjén szereplő kérdésekkel kapcsolatos nézeteiket;

c) megkapják a Közgyűlés napirendjét és nyilvános dokumentumait, továbbá megfigyelőket küldhetnek - felszólalási jog nélkül - a Közgyűlés nyilvános üléseire.

6. A Főtitkár vezeti azoknak a szervezeteknek a jegyzékét, amelyek az Európa Tanács mellett tanácskozó státussal rendelkeznek.

7. Minden olyan szervezet, amely azt kívánja, hogy ebbe a jegyzékbe felvegyék, kérelmet nyújt be az Európa Tanács Főtitkárához, csatolva hozzá harminc példányban egy francia és egy angol nyelven készített ügyiratot, amely a szervezet alapszabályát, tagszervezeteinek jegyzékét, a közelmúltban folytatott tevékenységéről szóló jelentést és azt a nyilatkozatot tartalmazza, amely szerint elfogadja az Európa Tanács Alapszabálya preambulumában és 1. cikkében kifejtett elveket.

8. A jegyzékbe felvett szervezetet a Főtitkár törölheti, ha véleménye szerint a kérdéses szervezet nem tett eleget a rá vonatkozó és a fenti 2., 3. és 7. bekezdésben meghatározott kötelezettségeknek, vagy ha egy szélesebb körű és a jegyzékben már szereplő szervezethez való csatlakozása következtében kétszeres képviselethez jutna. Mindazonáltal a Főtitkárnak előzetesen értesítenie kell a szóban forgó szervezetet a jegyzékről való törlési szándékáról, hogy ezáltal lehetőséget biztosítson a szervezetnek az ezzel kapcsolatos észrevételei előterjesztésére.

9. A Főtitkár hathavonként tájékoztatja a Miniszterek Bizottságát és a Tanácskozó Közgyűlést azoknak a szervezeteknek a nevéről, amelyeket fel kíván venni a jegyzékbe, vagy arról törölni szándékozik, mellékelve ügyirataikból az esetük megítéléséhez feltétlenül szükséges adatokat és azokat az érveket, amelyek a Főtitkár véleménye szerint a jegyzékre való felvételük vagy az onnan való törlésük mellett szólnak, tekintetbe véve a fenti 2., 3. és 7. bekezdésekben foglalt szabályokat. A Főtitkár feljegyzésének, amelyet valamely szervezet jegyzékről való törlésével kapcsolatban terjesztett be, tartalmaznia kell az érintett szervezetnek a Főtitkár szándékára vonatkozó esetleges észrevételeit. Amennyiben nem merült fel az alábbi 10. bekezdésben leírt ellenvetés, az így közölt neveket hat hónap elteltével, az esettől függően, fel kell venni a jegyzékbe, illetve törölni kell arról.

10. Ez alatt a hat hónapos időszak alatt a Miniszterek Bizottsága egy tagja vagy a Közgyűlés három tagja, akik legalább két különböző állam polgárai, kérhetik bármely olyan szervezet ügyiratának átvizsgálását, amelynek nevét a fentiek szerint közölték. Az első esetben a vizsgálatot végre kell hajtani, és azt követően a Miniszterek Bizottsága dönt a jegyzékbe való felvételről, illetve az onnan való törlésről. A második esetben a Közgyűlés az ügyben illetékes bizottsága jelentésének alapján ajánlást tesz a Miniszterek Bizottságához, amely véglegesen dönt. Amennyiben a szervezet ügyiratának átvizsgálását egyidőben kéri a Miniszterek Bizottsága egy tagja és a Közgyűlés három tagja, akik legalább két különböző állam állampolgárai, a Miniszterek Bizottsága csak azután hoz döntést, miután megkapta a Közgyűlés ajánlását.

11. A fent leírt eljárás nem korlátozza a Miniszterek Bizottsága és a Közgyűlés jogát arra nézve, hogy más nem-kormányközi szervezetekkel kapcsolatban ügyrendjüknek megfelelő kezdeményezéseket tegyenek.

12. Az olyan szervezet, amelynek jegyzékbe vételét elutasították vagy amelyet a jegyzékről töröltek, csak az ügyében hozott döntést követő három év elteltével nyújthat be újabb felvételi kérelmet.

13. Azok a szervezetek, amelyek a jelen szabályok hatályba lépésének napján az Európa Tanács mellett tanácskozói státussal bírnak, felkerülhetnek a fenti 2. bekezdésben említett, az Európa Tanács mellett tanácskozói státussal rendelkező szervezetek új jegyzékébe, de utóbb a jelen szabályok értelmében törölhetők is arról.

3. § Ez a törvény a kihirdetése napján lép hatályba, rendelkezéseit azonban 1990. november 6-tól kell alkalmazni.
